These Terms of Use (“Terms”) govern your use of the Kaisen mobile application (“Kaisen” or the “App”) provided by Winter Owls (“we,” “us,” or “our”). By downloading or using Kaisen, you agree to these Terms. If you do not agree, do not use the App.
Kaisen helps you build and track habits on iOS. Features may include habit creation, daily check-ins, insights, widgets, reminders, and optional paid features (“Kaisen Pro”). We may add, change, or remove features at any time.
You must be able to form a binding contract in your jurisdiction to use Kaisen. If you are under the age required in your country to consent to these Terms, you may use the App only with a parent or guardian’s permission.
We grant you a limited, non-exclusive, non-transferable, revocable license to use Kaisen for your personal, non-commercial use, subject to these Terms and the Apple Media Services Terms (for App Store downloads).

You are responsible for the habits and information you enter in Kaisen. You retain ownership of your content. You grant us only the rights needed to operate the App (for example, storing data on your device and displaying it to you).
Our Privacy Policy explains how we handle information. By using Kaisen, you also agree to the Privacy Policy.
Some features require a paid subscription (“Kaisen Pro”). Subscriptions are billed through your Apple ID via the App Store. Pricing, duration, and renewal terms are shown before you purchase.
Kaisen is a productivity and wellness tool, not a medical device or professional service. It does not provide medical, psychological, or other professional advice. Always consult a qualified professional for health or safety concerns.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that Kaisen will be uninterrupted, error-free, or that data will never be lost. You are responsible for backing up important information if needed.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINTER OWLS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF KAISEN.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR KAISEN PRO IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend and indemnify Winter Owls against claims arising from your misuse of the App or violation of these Terms, except where prohibited by law.
You may stop using Kaisen at any time by uninstalling the App. We may suspend or terminate access if you violate these Terms or if we discontinue the App. Sections that by nature should survive (such as disclaimers and limitations of liability) will survive termination.
We may update these Terms. We will post the updated version on this page and update the “Last updated” date. Your continued use after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory local consumer laws apply.
If you downloaded Kaisen from the App Store, Apple is not a party to these Terms and is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for Kaisen. In case of failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
